Zube Tech, Inc. - Terms and Conditions of Service

Welcome to Zube AI! These Terms and Conditions ("Terms") govern your use of the Zube AI platform, Zube Forums, or any other services provided by Zube (collectively, the "Service"). By creating an account or using our Service, you agree to be bound by these Terms.

Please read these Terms carefully. They contain important information about your legal rights and obligations.

1. Our Service

Zube AI provides a platform to help students ("Users") organize their academic information for the purpose of applying to universities and other educational institutions.

Some of Zube AI's functionalities include, but are not limited to:

  • Collecting personal and academic data and using an AI-powered tool to parse and transcribe this information into a structured format. This is only done so when you explicitly request for it by uploading your academic transcript.
  • Using your personal and academic data to provide tailored advice, recommendations, insights, and feedback to you. This is only done so when you explicitly request for it.

Important Note on Data Sharing and Visibility

  • If You Signed Up Yourself:
    If you created your Zube AI account independently (not through a school or institution), your personal and academic data will remain private and will not be shared or made visible to anyone else unless you explicitly choose to do so. For example, you may choose to share your information with a university you are interested in applying to, a scholarship provider, an accommodation provider, or a student loan provider. Such sharing only occurs when you actively request it by clicking to share or allow viewing - we will never share your data without your direct action and consent.

  • If Your Account Was Created by Your School:
    If your Zube AI account was created for you by your school or educational institution, your teachers, school staff, and any other parties the school chooses (such as parents or other stakeholders) may have access to your data. In these cases, the school controls who can view or share your information, and Zube AI does not have control over the school's data sharing decisions. Please consult your school for details about their data sharing policies.

  • If You Choose to Share With Your Parents or Others:
    If you choose to share your data with your parents (or guardians) by adding them as a 'supervisor' to your account, or if you choose to share with any other account, those individuals will be able to view your data as permitted by your sharing settings. You are always in control of who you share your information with, and can manage or revoke access at any time through your account settings.

2. User Accounts

  • Account Creation: Accounts on our Service may be created either (a) directly by you as an individual user, or (b) by an educational institution (such as a school) with which we have entered into a service agreement, in which case the institution may create accounts on behalf of its students. You agree to provide accurate, current, and complete information during the registration process, regardless of the method of account creation.
  • Account Security: You are responsible for safeguarding your password and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account. Zube Tech, Inc. cannot and will not be liable for any loss or damage arising from your failure to comply with this security obligation.
  • Account Deletion: If you created your account directly, you may request deletion of your account at any time by contacting us at privacy@getzube.com. If your account was created by an educational institution pursuant to a service agreement between Zube Tech, Inc. and that institution, your account may only be deleted upon the written request or authorization of the institution that created the account. In such cases, individual users may not unilaterally delete their accounts.
  • Account Suspension: We may suspend or terminate your account if you breach these Terms or if we are required to do so by law. We will provide you with reasonable notice where possible.

3. Important Information for Users Under 18

Our Service is designed for users aged 13 and over. If you are between 13 and 17 years old, you must have the permission of your parent or legal guardian to use our Service.

By creating an account, you confirm that:
a) You are at least 13 years old; and
b) If you are under 18, you have reviewed these Terms with your parent or guardian and they have agreed to them on your behalf.

4. Acceptable Use

You agree not to misuse the Service. For example, you must not:

  • Upload any data that is unlawful, harmful, or infringes on the rights of others.
  • Attempt to gain unauthorized access to our systems or engage in any activity that disrupts or impairs the functionality of the Service.
  • Use the Service for any commercial purpose without our prior written consent.
  • Provide false or misleading information.

5. Your Data and Our Privacy Policy

  • You Own Your Data: You retain full ownership of the personal data and academic information you upload to the Service.
  • Our Privacy Policy: Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review it carefully to understand how we collect, use, and protect your personal data. By using the Service, you agree to the data practices described in our Privacy Policy.

6. Intellectual Property

All rights, title, and interest in and to the Service (excluding your personal data), including all associated intellectual property rights, are and will remain the exclusive property of Zube Tech, Inc. and its licensors.

7. Termination

  • By You: You can terminate this agreement at any time by deleting your account through your account settings.
  • By Us: We may suspend or terminate your account if you breach these Terms or if we are required to do so by law. We will provide you with reasonable notice where possible.

8. Disclaimers and Limitation of Liability

  • Disclaimer: The Service is provided "AS IS" without warranty of any kind. While we strive to provide a high-quality service, we do not guarantee that it will always be secure, error-free, or uninterrupted.
  • Limitation of Liability: To the maximum extent permitted by law, Zube AI shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, resulting from your use of the Service.

9. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States. Any legal action or proceeding arising under these Terms will be brought exclusively in the state or federal courts located in Delaware, USA.

10. Changes to These Terms

We may update these Terms from time to time. If we make a material change, we will notify you by email or by posting a notice on our website before the change becomes effective. Your continued use of the Service after the effective date will constitute your acceptance of the new Terms.
